    Such searches allow the applicant to know, before filing a trademark application, the difficulties that may be encountered during the prosecution.

  • Trademark filing and prosecution

    We file and prosecute Spanish, European Union and international trademark applications. We also file and prosecute trademark applications worldwide through our network of foreign associates.

    We provide legal assistance throughout the entire process in order to ensure the best possible protection. For example, we advise on the best strategy to overcome obstacles and we prepare and file the most appropriate response.

    We permanently monitor our applications from the filing to the grant, as well as the renewal deadlines for maintaining the trademarks in force.

  • Trademarks watch service, oppositions and appeals

    Once a trademark is entered into our database, we start the watch service. The trademark is compared with every newly published Spanish application, European Union application or international application with effects in Spain. This system allows us to retrieve similar trademarks that are filed at a later date, so that we can advise our client and file an opposition, if appropriate.

    We file oppositions and appeals both before the Spanish Patent and Trademark Office (OEPM) and the European Union Intellectual Property Office (EUIPO), and we draft the corresponding grounds and arguments, using the most appropriate case law.

  • Negotiation of trademark coexistence agreements

    Sometimes the obstacles that arise during prosecution can be overcome by negotiating an agreement that benefits both parties. Because this is often a hard and lengthy task, we offer our services to handle the whole process.

  • IP agreements and negotiations

    ZBM handles all procedures of assignments, mergers, changes of name, licenses and other IP agreements, both for individual cases and full portfolios.
