In the last two “Lunes de Patentes” (Jornadas de estudio y actualización en materia de patentes), which took place on September 17th in Barcelona and on November 19th in Madrid, Bernabé Zea gave a lecture entitled “Patent validity: Evaluation of  sufficiency of disclosure and inventive step”.

In patent disputes it is increasingly common to claim the nullity of certain claims, either before the European Patent Office (EPO) itself, or before the national courts by means of a nullity action, or in a counterclaim following an infringement action.The conference dealt with some aspects of the causes of nullity that are most difficult to address: the insufficiency of disclosure and the lack of inventive step.
