After overcoming many obstacles, the Unified Patent Court Agreement will finally come into force on June 1, and with it the creation of the unitary patent in the 17 participating countries and the establishment of the Unified Patent Court (UPC).

From the opening of its doors, the new Court will make it possible to revoke or enforce European patents (unitary or classic) in a single centralized action in these countries. Thus, the UPC will also be competent to hear actions related to European patents that already existed before the entry into force, unless the holders expressly request the exclusion of the UPC’s jurisdiction.

With the implementation of this new system, a whole range of new strategies opens up in the field of patents in Europe. It is therefore essential that potential users, both patent holders and third parties, are aware of its advantages and risks.
